Party......?

Me and my friend were having a debate about this, so I thought Id see what you guys thought. If some people were having a party at their house, with underage drinking, and someone knew about it and called the cops. Would the police need a search warrant to come in and look? I said within one, they couldnt unless the clearly seen alcohol or drunk people when they opened the door. But my friend said if they had probable cause(like the phone call about it), they could go in a look. What is right?

They could ask to look based on the call but this is America and if you want to search you have to have permission from the property owner or a search warrant.
Reply:Yes the police can come to your door and ask for your ID, and if you are not 21 and they detect alcohol on your breath then they can enter the house and card everybody. A lot of times the police will disperse the crowd and send everybody home, usually citing the home owner, or people over 21.
Reply:If they had a call regarding it and they had probable cause yes they could enter to verify the report. It is just like searching a car...if they smell marijuana or something like that it gives them probable cause to search the vehicle. Same idea.
Reply:Probable cause, yes they can.. a call to them is probable cause.
Reply:they usually ask first but as far as i know they can come in without a warrant if they have probable cause, which can be intrepreted in any way the cops want. They're cops, remember they can do whatever they want.

Reply:if a criminal flees the scene of a crime and the police officer follows him, the officer has the right to enter an edifice in which the criminal has sought shelter.





Conversely, in authoritarian regimes, the police typically have the right to search property and people without having to provide justifications, or without having to secure an authorization from the judiciary.
Reply:Assuming you live in the USA, your friend is correct.
Reply:I dont think a phone call is good enough, the home is the most sacred property in the U.S., but police will try to make it seem like they have the right to come in, and will usually trick people into letting them in. ask them if you have a choice of letting them in, and they will usually say, "well you can either let us in now or we will have to call the judge and get a warrent". tell them to get a warrent, they will rarely ever be able to get one on such a meaningless charge. a friend of mine who went through a simmilar situation, but let the cops in, asked a judge friend of his if the police has ever called him up at night to get a warrent to search for underage drinking, and he said no, never.
Reply:******* snitches try living your life first. Are you so perfect that narcing out other people comes first. Thats some insane ****. You make me sick I would put a beat down on anyone who called my parties in. Live and let live or one day you might not be living.
